Welcome to Custom Okie ("we," "us," "our," or "Custom Okie"). These Terms of Service ("Terms") govern your access to and use of our website, including all content, products, and services offered (collectively, the "Site").

By accessing or using Custom Okie, you agree to be bound by these Terms. If you do not agree to any part of these Terms, please do not use our Site.

1. ACCEPTANCE OF TERMS

Your use of the Site constitutes acceptance of these Terms and our Privacy Policy. If you do not accept these Terms, you must stop using the Site immediately. We reserve the right to modify these Terms at any time without notice. Your continued use of the Site following any changes constitutes your acceptance of the new Terms.

2. USE LICENSE

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only, provided that:

  • You do not violate any laws or regulations
  • You do not infringe on anyone's intellectual property rights
  • You do not engage in any unlawful conduct
  • You do not disrupt the normal flow of dialogue within our Site
  • You do not attempt to gain unauthorized access to our systems

3. USER ACCOUNTS

If you create an account on our Site:

  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activity under your account

  • You agree to update information to keep it accurate

You are responsible for any unauthorized access to your account. Notify us immediately at hello@customokie.com if you suspect unauthorized use.

4. PRODUCT INFORMATION & PRICING

Product Descriptions: We strive to provide accurate descriptions and images of our products. However, we do not warrant that descriptions, images, or other content is accurate, complete, or error-free.

Pricing: All prices are subject to change without notice. Prices listed are in USD. Taxes (where applicable) will be calculated at checkout based on your shipping address.

Availability: Products are available while supplies last. We reserve the right to limit quantities and discontinue products at any time.

5. PRINTFUL MANUFACTURING

Custom Okie partners with Printful to manufacture and ship products. By ordering from Custom Okie, you understand that:

  • Products are manufactured by Printful according to our design specifications
  • Printful's quality standards apply to all products
  • Shipping is handled by Printful and their partners
  • Shipping times and costs are determined by Printful's current rates
  • Some items may arrive separately if ordered together

6. ORDERS & PAYMENT

Order Acceptance: We reserve the right to refuse, cancel, or suspend any order:

  • If we believe there's fraud or unauthorized use
  • If payment cannot be verified
  • If we cannot fulfill the order
  • For any reason at our discretion

Payment: By providing payment information, you authorize us to charge your payment method for your order. All transactions are processed securely through Shopify's payment processing system.

Taxes: You are responsible for any applicable sales taxes based on your location. Taxes are calculated and collected at checkout where applicable.

7. SHIPPING & DELIVERY

Shipping Times: Shipping times vary based on product type and destination. Estimated shipping times are provided at checkout but are not guaranteed.

Risk of Loss: Once your order ships, the risk of loss passes to you. We recommend purchasing shipping insurance through the carrier if you're concerned about loss or damage.

Delivery: Delivery dates are estimates only. We are not responsible for delays caused by:

  • Shipping carriers or their partners
  • Weather conditions
  • Natural disasters
  • Government actions
  • Other factors beyond our control

Missing or Damaged Items: If you receive a damaged or incorrect item, contact hello@customokie.com with photos within 5 days of delivery. We'll make it right.

8. SCHOOL FUNDRAISER PARTNERSHIPS

For Schools Using Custom Okie:

  • Your school earns 50% of proceeds from sales made through your store
  • Proceeds are calculated as sale price minus direct manufacturing and processing costs
  • Payments are made monthly for the previous month's sales
  • You are responsible for promoting your store to your community
  • You may pause or close your store at any time without penalty

Custom Okie does not:

  • Guarantee minimum sales or earnings
  • Require sales performance commitments
  • Require promotion (though more promotion = more sales)
  • Charge setup fees or monthly fees

9. INTELLECTUAL PROPERTY RIGHTS

Our Content: All content on the Site (including designs, text, images, logos, graphics) is the property of Custom Okie or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, modify, or distribute any content without permission
  • Use our designs or branding for commercial purposes without authorization
  • Create derivative works from our content
  • Remove or obscure any copyright or proprietary notices

School-Specific Designs: Designs created for schools are created specifically for that school's use through Custom Okie. Schools may not use these designs outside of the Custom Okie platform without written permission.

10. USER-GENERATED CONTENT

If you submit, post, or display content on our Site (including testimonials, reviews, or images):

  • You represent that you own or have the right to the content
  • You grant Custom Okie a worldwide, royalty-free license to use your content
  • You agree that your content is not defamatory, obscene, or harmful
  • You agree not to submit content that violates anyone's rights

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUSTOM OKIE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of data, profits, or business
  • Interruption of service
  • Any damages arising from use or inability to use the Site
  • Any damages caused by third-party products or services (including Printful)

Our total liability to you for any claim is limited to the amount you paid for the product in question.

12. DISCLAIMER OF WARRANTIES

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement of third-party rights
  • Accuracy of product descriptions
  • Quality of products

You use the Site and purchase products at your own risk.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Custom Okie, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

Governing Law: These Terms are governed by the laws of Oklahoma, without regard to its conflict of law provisions.

Jurisdiction: You agree that any legal action or proceeding related to these Terms will be brought exclusively in Oklahoma courts, and you consent to the jurisdiction and venue of these courts.

15. LIMITATION ON TIME TO FILE CLAIMS

You must bring any claim arising from these Terms or your use of the Site within one (1) year from when the claim arose, or you waive the right to bring the claim.

16. THIRD-PARTY LINKS

The Site may contain links to third-party websites, including:

  • Printful (our manufacturing partner)
  • Facebook and other social media
  • Other websites

We do not control, endorse, or assume responsibility for third-party websites. Your use of third-party websites is subject to their terms and privacy policies.

17. PRIVACY

Your use of the Site is also governed by our Privacy Policy. Please review our Privacy Policy to understand our privacy practices.

18. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in effect.

19. ENTIRE AGREEMENT

These Terms (including our Privacy Policy and Return Policy) constitute the entire agreement between you and Custom Okie regarding your use of the Site and purchase of products. Any prior agreements or understandings are superseded.
